To make a reservation for a short-term rental or vacation property, users must provide accurate and complete information through the booking platform. 2.2. Payment must be made through the booking.bbmahomeaway.com website using the available payment methods. Users agree to pay all fees and charges associated with their reservation. 2.3. Reservation confirmation will be sent to the email address provided by the user upon successful payment. 3. Cancellation and Refund Policy 3.1. Cancellation requests must be submitted through the BB&MA Home Away website. Refund eligibility is subject to the terms specified in the cancellation policy, which may vary based on the property and booking details. 3.2. BB&MA Home Away reserves the right to modify the cancellation and refund policy at any time. Users will be notified of changes through the website. 4. User Responsibilities 4.1. Users are responsible for providing accurate and up-to-date information during the booking process. 4.2. Users agree to abide by the rules and regulations set forth by the property owner or manager. Any violation may result in eviction without refund. 5. Security and Privacy 5.1. BB&MA Home Away employs industry-standard security measures to protect user data. However, users acknowledge that no online platform can guarantee absolute security. 5.2. Users' personal information will be handled in accordance with the privacy policy available on the BB&MA Home Away website. 6. Limitation of Liability 6.1. BB&MA Home Away is not responsible for any loss, damage, injury, or inconvenience resulting from the use of the direct booking website payment system or the stay at the rental property. 6.2. BB&MA Home Away's liability is limited to the amount paid by the user for the reservation. 7. Governing Law These terms and conditions are governed by and construed in accordance with the laws of Texas. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts in Texas. 8. Changes to Terms and Conditions BB&MA Home Away reserves the right to modify these terms and conditions at any time. Users will be notified of changes through the website, and continued use of the payment system constitutes acceptance of the modified terms.     Mariner’s Cove Terms & Conditions Terms & Conditions When you book with us, you and members of your party agree to follow the following terms and conditions outlined below. If you have any questions about these terms and conditions, please feel free to ask before confirming your booking or making payment. Cost Per Night: Rates Vary Standard Rate: The cost per night is twenty-one hundred dollars ($2,100.00 TTD); 2 night minimum; payable by card, cash, or deposited to the bank. T& T Locals rate: The cost per night is nineteen hundred dollars ($1,900.00 TTD) unless the stay is two nights or less, in which case it is twenty-one hundred per night ($2,100 TTD) payable by cash, card, or deposited to the bank. Event rate: The daily cost for an event ranges from $2,100 TTD to $5000 TTD depending on the event (dinners, meetings, weddings, etc.) and the number of people attending the event. An event concierge will be present for any event with more than 20 people in attendance. Maximum number of guests for an event: 25 Maximum Occupancy Maximum occupancy is 10 people. A registration form with all guest names and ages must be filled out prior to your stay. Additional overnight guests will be charged 2100TTD/guest/night. Eligibility of Main Guest: The Lead Guest must be 18 years or older at check-in time. Security deposit: A deposit equal to one night's stay is required as a security fee to confirm your booking. The deposit will offset any damages done to the property or returned to the lead Guest one day after departure when the villa inventory is checked and the property examined. Refer to “Damages” below for an explanation of what may be considered damages to the property. Booking Confirmation: Full payment or 50% of the total stay including deposit must be paid to secure booking. Damages: We reserve the right to charge the lead Guest for any damages caused by any member of the booking party during your stay. Damages include breakages, stains, broken, chipped, or missing furniture, fixtures, equipment, appliances, wares, utensils, sheets, blankets, towels, landscaping (including grassy areas), pool, pool safety ring, pool toys, pool loungers, and pool umbrellas. Should the cost of damage exceed the security fee, the Lead Guest is obligated to cover the entire cost for repairs or replacement as required. Accidental damages must be reported immediately by calling the number at the top of the agreement. Checking in: Check in is 3pm. Early check in is available on request. During peak seasons early check in will likely not be available however we do offer luggage storage while we prepare the villa for your stay. A unique code will be provided for the main entrance to the villa. No keys will be provided. A code will be provided for the gate lock prior to your arrival. Checking out: Guests must check out by 11pm. Late check out available upon request. Prior approval is needed for a late checkout, and an additional $100.00 TT may be charged for the extra time up to 3 pm. Checkouts after 3:00 pm and up to 8:00 pm require an additional payment of 50% of the nightly charge, and the full nightly rate amount will be charged for checkout after 8 pm. Cancellations: Guests who cancel at least 14 days before check-in will get back 100% of the amount they’ve paid. Guests who cancel 7-14 days before check-in will get back 50% of the amount paid. Guests who cancel 6 days before check-in will not be issued a refund. Failure to Show: We reserve the right to cancel your booking without refunding any portion of your payment if you fail to show up and do not cancel the booking on time, as outlined in above. Natural Disaster: Should there be a natural disaster that prevents guests from traveling to the Villa, after any portion of the payment, the Guest would have a choice of postponing the stay at the Villa to a convenient time, providing that the Villa is available on the requested date or requesting the total refund. Smoking: Smoking is prohibited inside of the Villa. However, you may smoke on porches and verandas. There will be an additional cleaning fee of 300TTD if there is evidence of smoking in the Villa and/or improper disposal of smoking materials. Pets: No pets are allowed on the property. Pool rules: Adherence to the pool rules is required. Users of the pool do so at their own risk. The Villa bears no liability or responsibility for accidents during its use. The pool safety ring is for rescue purposes only. It is not a pool toy. Pool toys will be available upon request. Failure to follow pool rules will result in forfeiting up to 50% of your deposit. Guests parking: Guests may park their vehicles on the property at your own risk. Please be mindful of the entrances to the surrounding villas when parking on the street. Please refrain from performing vehicle repair or maintenance (eg. Washing cars) at the villa. Absolutely NO parking on the grass. Any guest found in violation will be charged 100TTD/per violation/per day. Covid-19: Government Regulations regarding protocols must be followed. Security: There are external cameras located on the property. We reserve the right to review and securely store footage. We will not publish any security footage of your stay and data is automatically deleted after 6 months. Personal Data Information Retention: According to the Trinidad and Tobago Hotel and Guest House regulations, we must keep a register of guests over the age of 16. This includes providing their full names and nationality. If the Guest is a non-resident, additional information such as passport numbers, place of issue, and details of next destination if they are non-British, Irish, or Commonwealth. These records should be kept for a minimum of 12 months according to the Data Protection Act 1998 (DPA) and the General Data Protection Regulation (GDPR). The guest acknowledges receipt and understanding of the provided terms and conditions document. The guest agrees to abide by all terms and conditions outlined therein, and acknowledges that any violation may result in applicable consequences as specified in the document.
